What, if any, crime is being commited when bunk (fake dope) is sold?
well if there is an intent to sell and it is under the impression that it is dope, then it would be a crime. but i would be more affraid of the person you're trying to fu. ck over with the fake dope, cause they'll kill you first
Thanks for defining 'bunk!' I guess the crime would be fraud, but since the seller is faking something illegal to sell, I suspect few people would press charges against the seller!
intent, your guilty
You must be talking about Dallas. It happens all the time. Well, it will ruin a lot of lives in the process, but eventually the right people will end up in jail.
switch n bait? Stores are not allowed to do that. Advertise one item then switch you to something else. What they put in the ad is supposed to be available to be bought as exactly printed.
Saw it on a Cops show, some kid selling Catnip as Marijuana and still got busted for it.
sure they committed a crime but you did also when you bought their illegal drugs.
fraud...lol...even if you are caught it will still go down as intent to distribute a controlled substance.
intent to sell a controlled substance, even if it's fake.. your 'acting' as if it is a controlled substance.
Answers:
I'm pretty sure that the charges are the same either way, because in the very least, the person who was sold the 'bunk' has the potential to kill someone in retaliation.
As a recovering addict, I know from experience that when a person is 'jonesing', they will do ANYTHING to get their next hit (or fix). So, even if a person (and I use that term loosely) were caught selling fake drugs, the cops and judicial system will treat them the same, which I agree with entirely.
