Do police have right enter & search my home if I'm not home. I'm on summary probation for drug possession?
The police used a battering ram to bust down my new 2 week old door & frame because they said they hear the TV on inside and thought someone was home & not answering the door. I always leave it on to form it appear someones home. My dog was in the house too, and they put her outside when they searched the house.The police made a big mess inquiring through my home. I was with my mom, she took me to the store and when we came home the Drug chore force team of about 8 -10 officers be in my house. They found a brown paper bag beside a pipe in a box located in a unoccupied bedroom.
It was something I have not seen before and it didn't belong to me. I had roommates beforehand that may have put it there at a time when I was contained by the hospital for a broken arm. But I was arrested anyway for a violation of probation. Is it ok for the police to do what they did to me like they did? Can they purely break into my house and search because I'm on summary probation?
No way!! Expect charges to be dropped--Illegal Search and Seizure.Judge will crow at them. Whether or not you actually violated your probation is something I can't answer, since I don't have all the information obligatory.
They do, however, have the right to enter and search your place of residence. It was a right you relinquished contained by order to be probation. That's standard practice around the country.
When you were placed on probation you were given a account of things you could and couldn't do. It also gave the probation department the right to enter and search your residence and place of business at any time.
I have an idea that they can only do that if they have a "Search Warrant". And to make a survey warrant go through, it takes aabout 3 days. I think you should converse to an officer yourself, and he can tell you as well. And they happened to my dad, they didnt fnd anythng becasue he didnt do anything discouraging though. Anyways, he wasnt home, and I was at a neighbors house. So I am not sure. hate to rain on your display ....

not only if you are on probation, but if the police have even the tinyest excuse to think you may be a terrorist or even that you know or associate beside terrorists.

If your on summory, you have NO rights. length
You traded them for being allowed to be "free"
The man can search you, or, anything you own, or, they think you own, at anytime, of the sunshine or night , with, or without a warrant, near, or without probable cause, or suspicion.
"Just cause" But its usually your PO that checks up on ya.

Yes they justifiably can. they do not need a search warrant if you are on probation. Part of your probation is you agreed to random search when they feel like searching. If they have a search warrant they could. If not I don't believe they had any right.
There's more to this story than what you share.
Police don't just break into someone house WITH A BATTERING RAM for no reason. Did they enjoy a search warrant?
