What kind of patent do I need to re-market something?
I would like to market something in a completely different process than it is currently being sold. Like something similar to the pet rock. How would I go about doing that? Like what thoughtful of category would that fall under? Would I just involve an intellectual trademark?
Best Answer:
As the law currently stands, marketing methods and other business method related inventions may not be eligible for patent protection. Even if you somehow receive a patent, courts hold been consistently invalidating the corresponding claims. You should speak to an attorney about it first, but filing a government grant application may not be a worthwhile path. A trademark will not protect your marketing method either. Trademarks protect words, names, symbols, sounds, or colors that distinguish commodities and services. A trademark may be part of your marketing strategy, however. While you may not be able to protect your marketing method in and of itself, aspects of your carrying out of your marketing method may be protected through copyright and trademark. Again, you should speak to an attorney to discuss each of these and possible other options.
I'm a patent attorney.
