is getting money for a work without doing it considered theft of services?

I paid thousands of dollars as a deposit to start a construction in my house. It has be 10 months and I don't even have permits or plans of the construction. The constructor doesn't want to return the money or start work until I'm approved by a bank. Is that break-in?

Depends on what your agreement with him says. Why would he start something that you may not be able to repay for him to finish?
